Stack Build Invest (hereinafter, "Stack Build Invest," "the Company," "we," "us," or "our") operates as an educational and financial literacy platform, providing access to digital resources, courses, coaching, and related online services (collectively, the "Services") through its website stackbuildinvest.com (the "Site"), applications, and affiliated channels.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "user," "student," or "member") and Stack Build Invest. By creating an account, purchasing content, or otherwise accessing or using the Services, you acknowledge and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, you must immediately discontinue use of the Services.

1. Acceptance of Terms

By registering for an account or otherwise using the Services, you expressly:

• Acknowledge that you have read, understood, and accepted these Terms;
• Consent to the collection, processing, and handling of your personal information as described in our Privacy Policy; and
• Agree to be bound by any additional terms applicable to promotions, offers, or supplemental services.

No person under the age of consent for online services in their jurisdiction may use the Services without parental or guardian authorization.

2. Modification of Terms

The Company reserves the right, in its sole discretion, to amend, modify, or update these Terms at any time. The most current version will supersede all prior versions. In the event of a material modification, we will notify users via the email address associated with their account. Continued use of the Services following such modifications constitutes acceptance of the revised Terms.

You consent to receive communications from the Company electronically. All notices, disclosures, and other communications delivered electronically shall satisfy any legal requirement that such communications be in writing. 4. Media Release and Likeness Waiver

By engaging with the Services, you irrevocably grant Stack Build Invest the unrestricted, worldwide right to use your name, likeness, image, voice, and related recordings (collectively, "Likeness") for promotional, advertising, and educational purposes across all forms of media, without compensation. You waive all rights of inspection, approval, or ownership in such materials, and release Stack Build Invest from any liability arising therefrom.

5. Accounts and Security

To access the Services, you must register for an account. You agree to:

• Provide accurate and current information;
• Maintain the confidentiality of your login credentials; and
• Accept full responsibility for all activities under your account.

You may not transfer or assign your account. Stack Build Invest shall not be liable for unauthorized use of your account resulting from your failure to secure your credentials.

6. License and Access to Content

Enrollment in courses or purchase of digital content grants you a limited, non-exclusive, non-transferable, revocable license to access such content solely for personal, non-commercial educational purposes.

You expressly agree not to:

• Copy, reproduce, resell, distribute, or publicly display content;
• Share account access with third parties; or
• Create derivative works without prior written authorization.

Stack Build Invest reserves the right to revoke access if content becomes legally or contractually unavailable. "Lifetime access" refers to course content only and does not guarantee continued instructor support.

7. Refund and Cancellation Policy

The Company enforces a strict NO REFUND policy. Upon successful payment and delivery of access credentials, all sales are final.

• Erroneous payments must be reported immediately to stackbuildinvest@gmail.com.
• Unauthorized chargebacks or refund attempts may result in termination of your account and forfeiture of access.
• Service cancellations after payment do not entitle you to reimbursement.

8. Intellectual Property

All content, code, trademarks, service marks, logos, and materials provided through the Services are the exclusive property of Stack Build Invest Ltd. or its licensors. You acquire no ownership rights by virtue of access. Any unauthorized use constitutes infringement and may result in civil or criminal liability.

9. Privacy and Data Protection

Stack Build Invest complies with applicable data protection laws, including the EU General Data Protection Regulation (GDPR). We collect and process personal information strictly for lawful purposes, including compliance with Know Your Customer (KYC), Anti-Money Laundering (AML), fraud prevention, and contractual performance. 10. Limitation of Liability

To the fullest extent permitted by law:

• Stack Build Invest disclaims liability for indirect, incidental, special, or consequential damages, including but not limited to lost profits, loss of data, or business interruption.
• Our maximum liability to you shall not exceed the amount paid by you in the twelve (12) months preceding the claim.

Some jurisdictions do not permit exclusion of certain damages; in such cases, our liability shall be limited to the minimum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Stack Build Invest Ltd., its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, expenses, or costs (including attorneys' fees) arising out of your misuse of the Services, breach of these Terms, or violation of third-party rights.

12. Disclaimer of Warranties

The Services are provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied. The Company does not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

13. Arbitration Agreement and Governing Law

a. Agreement to Arbitrate: Any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or your relationship with Stack Build Invest shall be resolved exclusively by binding arbitration under the rules of the Jamaica International Arbitration Centre (JIAC), or if unavailable, a mutually agreed arbitral forum.

b. Class Action Waiver: You and Stack Build Invest agree that arbitration shall be conducted solely on an individual basis, and not as a class action, collective action, or representative proceeding.

c. Governing Law: These Terms shall be governed by and construed in accordance with the laws of Jamaica, without regard to its conflict of laws principles.

d. Venue: The seat of arbitration shall be Kingston, Jamaica, unless otherwise agreed in writing by both parties.

14. Severability

If any provision of these Terms is found invalid or unenforceable, that provision shall be severed, and the remaining Terms shall continue in full force and effect.
